Yes, in most cases, once a personal representative has been appointed and has authority to act. You do not have to wait for the entire estate to close.
That surprises families constantly, and the misunderstanding costs them months. If you’re trying to sell probate property in Orange Park, the question isn’t whether probate is finished. It’s whether somebody has the legal authority to sign a deed.
I’m not an attorney and this isn’t legal advice. Whether and how you can sell depends on the will, the type of administration, and what the court has authorized. Get an hour with a lawyer early, because it costs less than the months it saves.
What has to happen first
The court appoints a personal representative and issues letters of administration. That document is what proves authority, and no title company will close without it.
Until that exists, nobody can sell anything, and this is the single most common reason an inherited house sits untouched for months. The frustrating version is when everyone involved is ready and willing and the only thing missing is a signature nobody is yet permitted to give.
So the order of operations is: talk to a probate attorney, get somebody appointed, then talk about selling. People do it backwards constantly and lose a season to it.
Common questions
Does the sale need court approval?
It depends on the will and the type of administration. Some wills grant the personal representative broad power to sell without returning to the court. In other situations a petition and an order are required.
Your attorney can tell you which applies in about one phone call, and the answer changes your timeline meaningfully. Ask specifically, because it’s the difference between weeks and months.
What about summary administration?
Florida has a shorter path when an estate falls under a statutory value threshold or the death was long enough ago. It moves considerably faster than formal administration.
If an attorney says the estate qualifies, that’s genuinely good news. Ask about it by name, because nobody volunteers it and the difference is measured in months of taxes at roughly 15.05 mills countywide, insurance, and utilities on a house nobody is living in.
What if the heirs disagree?
Nothing moves until that resolves, and it’s what actually makes probate take a year rather than the paperwork.
One person wants to keep it. One wants it gone. One lives out of state and just wants the calls to stop. What breaks the logjam more reliably than anything a lawyer says is a real number on the table. Three people guessing what a house might be worth will argue indefinitely. Three people looking at a firm written offer are having a much shorter conversation, even if they reject it.
Can we accept an offer before letters are issued?
You can generally get an offer and know your number. What you can’t do is close.
Which is actually useful. Getting a firm figure while probate runs means the day authority is granted you’re not starting from zero. It costs nothing and it compresses everything that follows.

Do we have to clean it out first?
No. Take what matters to the family and leave the rest.
Families burn entire weekends and real money on this before they call anybody. We Buy Houses Orange Park buys houses with the furniture still in them and the garage still packed. One thing to do regardless of who buys it: photograph every room before anybody hauls anything off, because relatives remember things differently six months later and dated photos have settled more arguments than any conversation I’ve been part of.
What about the mortgage while this drags on?
Somebody has to pay it or it goes into default like any other loan. Federal law generally lets an heir take over an existing mortgage rather than triggering the due-on-sale clause, which helps if somebody can actually make the payments.
If the estate is covering it out of an account that’s draining, you’re on a clock whether it feels like one or not.
If the house has a mortgage larger than it’s worth, selling it may require the lender’s cooperation rather than just the court’s, which is a different conversation and worth raising with the attorney early.
It’s also worth knowing that heirs generally aren’t personally liable for the deceased’s mortgage debt. The loan is secured by the property, and if the estate can’t or won’t pay it, the lender’s remedy is generally against the house rather than against you personally. That surprises families who have been losing sleep over inheriting a debt.
Ask a probate attorney how it applies to your specific situation before you act on that, because there are exceptions and it depends on how things are titled.
As for whether you need to fix anything before selling: usually not, and I’d push back hard on anybody telling an estate to renovate.
Money spent on a house the family is leaving comes back only if everything else goes right, and on a big-ticket item like a roof it mostly doesn’t come back at all. A new roof doesn’t add the price of a roof to your number, it just removes a reason for somebody to say no. Meanwhile the estate is paying carrying costs for the whole renovation period.
Cheap and cosmetic is different. Haul the junk, cut the grass, get the AC to turn on. Under a thousand dollars, roughly, and it genuinely helps.
Two things to handle this week regardless
Call the insurance carrier and tell them the house is vacant. Most homeowners policies restrict or void coverage once a property has been unoccupied past a set period, often around 30 or 60 days, and a pipe letting go in an uninsured empty house during probate is a genuinely brutal way to lose most of what the estate was going to receive.
Then find out which government you’re dealing with. Inside the incorporated Town of Orange Park, the town handles code compliance and vacant property requirements. In Bellair, Lakeside, Oakleaf, and most of the surrounding area, it’s Clay County. The mailing address tells you nothing, and an overgrown lot is what generates the complaint that generates the file.
How the two paths compare here
A marketed sale is available once authority exists, and on a house in decent shape with agreeable heirs it’s worth pricing out. Count what comes off: commission on both sides, whatever the inspection turns up on a house of this age, the cleanout, and the months of taxes and insurance while it sits. April 2026 data showed the typical Clay County seller closing at around 94.8% of asking.
A direct sale takes less and gives you a date you can set around the court’s schedule rather than against it, with no cleanout and no showings coordinated from wherever the heirs actually live.
I grew up in Montclair and I’ve been doing this here for six years, and the estates that come out best are consistently the ones where somebody got a real number early and stopped the monthly bleed. Not the ones that waited for probate to finish before they started thinking about it.
There’s more on how a probate sale runs on our end, and the wider inherited property picture is here. For the legal side, the Florida Bar’s consumer guide to probate is genuinely readable and worth twenty minutes before you call an attorney.
